Also, do you have an opinion on whether the fact he "confessed" (falsely) diminishes his claim?
I imagine it will be used that way, however, it's possible any reduction for that might be offset by an increase because of his additional vulnerability and disability.

Note that s.23 doesn't say "the only way a vacancy in the House can occur is through s.55 of the Electoral Act." Rather, it simply rules out one particular way in which a vacancy may have been able to occur - through the expulsion of a member .
It does use the words "Members’ seats become vacant only as provided in Electoral Act 1993". Heading, I concede, but we can use those now. It's a strong point for the proposition that Parliament does not consider there are other ways a seat could become vacant. The idea that there are other means by which is seat could become vacant is so outlandish, that they don't even need to pass a law making that clear.

Thanks Sean – I accept that Electoral Commission are in good faith telling people that. However, they are not the arbiters of whether a vacancy is created or not.
I see that as the Electoral Commission addressing the non-controversial position of what happens if Winston Peters does resign. I didn’t think we disagreed over that.
Are you seriously suggesting that it is possible that, if Winston was to pen a resignation letter to the Speaker in the week after Easter, the Speaker might either decline to accept it, or refer the question of whether he should accept it to the Privileges Committee?

I raised that possibility!

Everyone assumes a by-election-winning list MP would resign to allow their party an extra MP, but they could decide not to...

As for why they're doing this: my guess is that when they wrote the perk into the new law, they didn't realise what the lowest cost business class return fare actually cost.

I disagree. Entirely planned consequences, which were a clear policy choice subsequently confirmed by the recent Electoral Commission review of MMP.
Agree with the approach or not (and there are arguments both ways) this is not an accident.

Which I think means that he could resign, in order to install the next list MP, before the official return but after the polls have closed and by doing so he would not stand the risk of losing his place on the list if he were to lose, as it were?.
That's what I meant: after the voting, is fine, but if he resigns after the writ for the by-election is made official, he'd be resigning as the electorate MP, and then there'd have to be another by-election.
