No. Lange v Atkinson related to the question of whether there exists a qualified privilege defence for an individual who is sued in defamation by a politician, on the basis of things the individual says about the politician's public actions. It has nothing to do with privacy.
And what law does the PunkAs commentator think the Herald should be prosecuted under, if it doesn't publish the recording? The law of "not doing what I want"?

That is what I thought too.
The fact that Key has gone to the trouble of involving the police would tend to make people think there was something worth hiding, however, I would not be at all surprised if National release the tapes themselves just before the election showing that there was nothing of importance in them thus stifling more important issues and making Key appear to be "open and honest"
I do still stand by what I said earlier that it is about Peters being considered for a position in a coalition. -

Oh, Sasha - I think there are legitimate ethical questions here, and assessing any possible illegality is way above my pay grade. But, yeah, my hackles start to ripple when folks think saying "photo op" shuts down any argument. I've just submitted to The Listener my review of the new Stephen King. My review copy was under a pre-publication embargo. I could have been a smart-arse and printed an embargo-busting review here, and it's an open question whether such embargoes are legally binding or enforceable. Don't think, however, Russell or The Listener would particularly want to die in a ditch testing that in court. (Nor, to be honest, would I blame Guy Somerset for deciding my services were less valuable to him that his relationship with King's publisher.)

It is, after all, a fairly straightforward question that could be put to ACT without needing to hear any secret tapes. They're standing Banks and not Brash in the electorate. This means there is every chance Banks could end up in Parliament and Brash could miss out.

NZ First leader Winston Peters told 3 News he thought Mr Key should “release them”
And this morning on RNZ Winnie was saying that the media were engaging in despicable, illegal News of the World tactics and that was all there was to it. A day is a long time in politics.
I'm not surprised, of course - not that anyone would be surprised by his antics.

A few minutes ago I was called on my landline to participate in a NZ Herald Digi Poll, for my opinion on current election-related events.
Amongst the questions you'd expect - how are you voting for: party/electorate/MMP referendum- and a couple around National Standards, moving to Australia etc.
I was surprised that there were none about "Tapegate" and one randomly thrown in the middle: "Of these leaders, who do you think would be kindest to animals?". The choice being the 5 male party leaders (no Turia/Turei).
so, does this mean that the NZH is backing away entirely, or just that Hamilton-based pollsters have been won over by Phil Goff's Twitter feed?

they ask if you're the householder, over 18, and enrolled to vote- then the questions- then the demographic stuff.
The woman talked at the start and conclusion about how it wasn't a sales pitch and about how I was in the draw to win a $500 voucher.
I don't think it was too soon for a question about the tape- one was about if recent activity by ACT had "discredited" it

I'm afraid to ask. :) But journalists accept access restrictions, some reasonable and others not so much, all the time. Doesn't immediately follow that there's some evil secret agenda in play. Really. Promise.

Just been having some brief interaction with Henare on Twitter: he’s doubling down on the NOTW comparison and a comparison with Watergate. Doesn’t seem to realise that that journalists were the heroes in Watergate.
That said, there are real ethical quandries around the incident itself- but that’s a separate issue.
There are, but it seems to me to be similar to Gordon Brown’s “that woman” moment and the more recent Obama/Sarkozy discussion. In both cases, the subjects didn’t know they were being recorded. Both cases involved conventional mics and transmitting equipment used by journalists.
I’m also fairly appalled at the response from National. I feel some loyalty to fellow journalists here, and the pursuit of a criminal complaint against an editor who, after all, did not publish the transcript gives me the shits.
