..I don't necessarily disagree...I just think it would be odd to have a law that stopped list MPs standing in bye-elections but not general elections its either one or the other (for me )...

surely if a list mp cant stand in a by-election they should also be "banned" from standing in a seat at the general election and being on the list ? Otherwise we are creating a strange demarcation as by-elections are just a way of replacing departed MPs ...

if he was smart he would resign the northland seat and keep the list seat , then northland could have another by-election and we might get offered personal jet packs and gold plated bridges ....

I asked the electoral commission about this a few weeks ago. The response from them I have pasted below ...
The Electoral Act 1993 provides the legal framework for parliamentary elections. A person is eligible to contest a parliamentary election provided he or she is:
· Enrolled as a voter
· A NZ citizen, and
· Not disqualified from enrolling (see section 47 of the Electoral Act).
The fact that a person is a list MP does not disqualify the person from contesting a by-election. At a general election a person can contest an electorate seat and be on the party list.
Section 55 of the Electoral Act specifies the circumstances where an MP’s seat may become vacant. There is no requirement for a list MP to resign his or her seat should the MP decide to contest a by-election. If a list MP is the winning candidate at a by-election he or she may then resign his or her seat in accordance with section 55(1)(f) by giving written notice to the Speaker. Where a list vacancy arises the seat is filled with the next person on the party’s list.

ok but I don't think they are more "worthy" they are different (to me anyway). However assume that the voters of Northland were aware of Sabins "issues" or felt there was personal issues with him and had rejected him at the 2014 election but hed been high on the list, at that point they would have concerns..(im not suggesting Little has Sabins issues) the current list set up doesn't allow any discretion other than a totality approach and we have seen in many systems politicians aren't necessarily herd animals in terms of personal behaviour.

..which is fine , but I find the use of the words "worthy" of my logic (not my commas) sarcastic ....I am content with my logic (or I would change it...logically) and content that others don't agree with it..cant that be challenged openly ?
