There is however the partial defence of - I forget what it's technically called - blind rage.
This is basically a defence of insanity, I think, albeit temporary. It's the old "I was out of control and therefore not responsible for my actions" one.
And yes, the gay panic defence was absolutely disgusting and I hope it gets excised from the case law at the earliest possible opportunity. Perhaps McVicar is wanting to create a tagger panic defence too?

Perhaps Andrew S you were thinking of [Sandra Goudie, National MP, and her mates who did not even get prosecuted for illegally clearing mangroves in Whangamata? (Link is to an old post, but there was no prosecution in the end).
Last I checked "frustration" was not a defence to murder. Perhaps McVicar is trying to expand "self-defence" to include the right to kill someone who is really really pissing you off?

Congrats to Public Address! Well done those people.
In regards to Mark - what label would you afix then to a comment here about what a waste of time this "utterly pointless" blog is? I hope you type fast, time being money and all that.
Thanks to Joanna too for linking to the stuff at The Hand Mirror about the ALAC advert, "Lisa." As of right now I've yet to have a reply from ALAC or the ASA (other than to acknowledge receipt), and my comment to a story about the advert on the ALAC blog has yet to make it through moderation. Let me assure you it is not at all offensive, but does contain links to the posts up at The Hand Mirror expressing concern about the rape myths the ad perpetuates.

A (male) friend of mine who did some supply teaching in London was constantly referred to by his intermediate-age students as "Miss". They had never had a male teacher before and thought Miss was the title you gave all teachers, regardless of gender.

I hear you Paul, I get "ma'am" a lot these days. It seems like just yesterday I was ma'aming and siring myself.

Well I started writing a comment to your excellent post, Sir, but it got too long, so I'm shamelessly linking to it at The Hand Mirror instead :-)
It's quite nice having a unique name, means you can almost guarantee to only get your own self when doing ego searches!

Andrew I can't finish reading what you wrote right now, cos I'll cry and cry, but I just wanted to add my big hugs too. It's been a pretty sucky couple of weeks for personal and public tragedy imho.

Gosh Jackie, why did people walk out??

Fantastic post Keith. Regular analysis of this nature would hopefully have the effect of getting politicians to pull their socks up, to avoid being embarassed. Hopefully your approach will catch on more widely and it won't just be up to you!

Mr Kennaway, you have only to date seen my lovely son in 2D (iirc). Wait until you get the full experience before you judge whether I have defamed him or not ;-)
Actually he's a good little tyke really. Most of the time. The last few days have been an exception. I hope. Can you tell that I'm not quite sure what I'm doing?
IntObs, you might actually be surprised how many people have told us that we should give our baby (and I'm talking really really young baby) alcohol to aid sleeping. Get it to suck some off your finger, rub some on baby's gums, add it to the bottle, whatever. They've all been serious.
David, your Bob looks just grand, and from your writing he sounds like a real character too. People keep telling me just wait until Wriggly is 6 months old and then he won't be so boring, but I am actually finding him fascinating now at under half that. I suspect your Bob and my Wriggly could keep each other amused for hours. Heaven forfend they should ever meet, or surely they will plot our downfall.
